Terms of Service
Effective Date: October 25, 2026 • Last Updated: October 25, 2026
Welcome to Climp, a serverless email marketing workstation developed and provided by WhichDrive (whichdrive.in). These Terms of Service ("Terms") govern your access to and use of Climp.
1 Acceptance of Terms
By accessing Climp via climp.whichdrive.in or any associated WhichDrive portal, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the service.
2 Description of the Service
Climp provides users with a client-side email marketing workstation designed to draft, preview, schedule, and dispatch email campaigns using:
- WhichDrive Identity Gateway: Single sign-on authentication through WhichDrive.
- User-Owned Google Sheets Database: Direct synchronization of contacts, lists, templates, and analytics into the user's private Google Sheet.
- Brevo SMTP / REST Dispatch: Execution of campaign delivery via the user's personal Brevo credentials.
Climp strictly prohibits the sending of unsolicited bulk email (spam). You must comply with all applicable anti-spam and privacy laws, including the U.S. CAN-SPAM Act, the EU General Data Protection Regulation (GDPR), Canada's Anti-Spam Legislation (CASL), and India's Information Technology Act.
As a Climp user, you represent and warrant that:
- Permission-Based Contacts: You only send campaigns to recipients who have explicitly opted in or consented to receive communications from your organization.
- Mandatory Unsubscribe Mechanism: All broadcast emails must include an active, functioning unsubscribe link (such as Climp's integrated 1-click unsubscribe page).
- Accurate Sender Information: From addresses, headers, and subject lines must honestly identify your identity or legal entity.
- Prohibited Content: You will not use Climp for phishing, deceptive advertising, distributing malware, pyramid schemes, or hate speech.
4 Third-Party Services and Quotas
Climp relies on third-party integrations (Google Cloud, Google Drive, Google Sheets, Brevo, and WhichDrive). You acknowledge that:
- You are responsible for obtaining and maintaining valid accounts and API access with Google and Brevo.
- You are subject to Google's and Brevo's respective terms of service, acceptable use policies, and API rate limits.
- WhichDrive is not liable for service interruptions caused by third-party outages, rate limits, or account suspensions imposed by Google or Brevo.
5 Intellectual Property and Data Ownership
- Your Content: You retain 100% intellectual property ownership of your audience lists, email copies, design templates, and campaign assets stored in your Google Sheets.
- Climp & WhichDrive: The Climp workstation application, code, interface designs, trademarks, logos, and documentation are the exclusive intellectual property of WhichDrive.
6 Disclaimer of Warranties
Climp is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee 100% inbox delivery rates, as email deliverability depends on sender reputation, DNS setup (SPF/DKIM/DMARC), and ISP filtering.
7 Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall WhichDrive, its directors, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data loss, or business interruption arising out of your use of or inability to use Climp.
8 Modifications and Termination
WhichDrive reserves the right to update or modify these Terms at any time by publishing updated versions on this page. Your continued use of Climp following such modifications constitutes your acceptance of the revised Terms. You may terminate your relationship with Climp at any time by ceasing use and disconnecting your Google Sheet.
